Terms of Service
Welcome to YugoVIN. These Terms of Service ("Terms") govern your use of the YugoVIN VIN decoding API and related services ("Service") provided by YugoVIN ("we," "us," or "our").
1. Acceptance of Terms
By creating an account, accessing, or using the YugoVIN API, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
You represent that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
2. Service Description
YugoVIN provides a Vehicle Identification Number (VIN) decoding API that returns detailed vehicle information including make, model, year, engine specifications, and other attributes. Our service includes:
- RESTful API for VIN decoding
- Batch processing capabilities
- VIN validation endpoints
- Dashboard for usage monitoring and API key management
- Technical documentation and support
3. Account Registration
3.1 Account Creation
To use our Service, you must:
- Create an account with a valid email address
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update your information if it changes
3.2 Account Security
You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use or security breach. We are not liable for any loss or damage arising from your failure to protect your account credentials.
4. API Usage and Rate Limits
4.1 API Keys
API keys are unique to your account and must be kept confidential. You may not share, sell, or transfer API keys to third parties. Each API key is subject to the rate limits and request quotas of your subscription plan.
4.2 Rate Limits
Your subscription plan determines your rate limits:
- Starter ($15/mo): 500 requests/month, 2 requests/second
- Basic ($49/mo): 2,000 requests/month, 5 requests/second
- Pro ($199/mo): 10,000 requests/month, 20 requests/second
- Scale ($999/mo): 50,000 requests/month, 50 requests/second
- Enterprise: Custom limits based on agreement
Exceeding rate limits will result in HTTP 429 (Too Many Requests) responses. Persistent abuse may result in temporary or permanent suspension.
4.3 Demo/Trial Usage
New accounts receive 50 free API requests or 7 days of access, whichever comes first. Demo usage is intended for evaluation purposes only.
5. Payment and Billing
5.1 Subscription Plans
Paid subscriptions are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
5.2 Payment Processing
Payments are processed securely by Stripe. We do not store your full credit card information. You agree to Stripe's terms of service for payment processing.
5.3 Billing Cycle
Your billing cycle begins on the day you subscribe and renews monthly on the same date. Request quotas reset at the beginning of each billing cycle.
5.4 Failed Payments
If a payment fails, we will attempt to retry. After three failed attempts, your API access may be suspended until payment is resolved. You remain responsible for any outstanding charges.
6. Billing Terms
6.1 Subscription Renewals
All paid subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled before the renewal date. Your payment method will be charged on the renewal date. You can cancel auto-renewal at any time through your dashboard.
6.2 Plan Upgrades
When you upgrade to a higher-tier plan, the change takes effect immediately. You will be charged a prorated amount for the remainder of your current billing cycle based on the difference between your old and new plan prices. Your monthly quota will increase immediately to reflect your new plan.
6.3 Plan Downgrades
When you downgrade to a lower-tier plan, the change takes effect at the start of your next billing cycle. You will continue to have access to your current plan's features and quota until your renewal date. A prorated credit will be applied to your account for future invoices.
6.4 Plan Change Restrictions
To prevent abuse, there is a 3-day cooldown period between plan changes. After changing your plan, you must wait 3 days before making another change. This applies to both upgrades and downgrades.
6.5 Account Credits
Credits from prorated downgrades or other adjustments are applied to your account balance. Credits are automatically applied to future invoices. Credits are non-transferable and have no cash value. Unused credits expire if your account is cancelled.
6.6 Overage Charges
If your API usage exceeds your plan's monthly quota, you will be charged overage fees at the following rates:
- Starter: $0.045 per additional decode (4.5 cents)
- Basic: $0.037 per additional decode (3.7 cents)
- Pro: $0.030 per additional decode (3.0 cents)
- Scale: $0.025 per additional decode (2.5 cents)
- Enterprise: Custom rates based on agreement
Monthly subscriptions: Overage charges are calculated at the end of each billing period and added to your renewal invoice.
Annual subscriptions: Overages are billed monthly (on the 1st of each month) as a separate invoice to avoid large surprise charges at year-end.
Your API access will not be interrupted when you exceed your quota. We recommend monitoring your usage in the dashboard and upgrading your plan if you consistently exceed your quota, as upgrading may be more cost-effective than paying overage fees.
7. Cancellation and Refunds
7.1 Cancellation
You may cancel your subscription at any time through your dashboard. Upon cancellation:
- Access continues until the end of your current billing period
- No refund is provided for the remaining time
- Your account data is retained for 30 days, then deleted
7.2 Refund Policy
We offer a 7-day money-back guarantee for new paid subscriptions. If you are not satisfied within 7 days of your first payment, contact us for a full refund. After 7 days, no refunds are provided except as required by law.
7.3 Termination by Us
We may terminate or suspend your account immediately, without prior notice, if you:
- Violate these Terms
- Engage in abusive or fraudulent activity
- Fail to pay for services
- Endanger the security or performance of our Service
8. Prohibited Uses
You agree NOT to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights
- Transmit malware, viruses, or malicious code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Resell or redistribute API access without authorization
- Use automated tools to scrape or harvest data beyond API access
- Circumvent rate limits or usage restrictions
- Engage in activities that could harm our reputation
9. Intellectual Property
9.1 Our Intellectual Property
The Service, including its design, features, documentation, and code, is owned by YugoVIN and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
9.2 Vehicle Data
Vehicle data provided through our API is sourced from authoritative public and government databases. This data is provided "as is" and we make no claims of ownership over the underlying vehicle information.
9.3 Your Content
You retain ownership of data you submit through the Service. By using our Service, you grant us a license to process your data as necessary to provide the Service.
10. Disclaimer of Warranties
We do not warrant that:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The data provided is 100% accurate or complete
- The Service will meet your specific requirements
11. Limitation of Liability
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless YugoVIN and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your negligence or misconduct
13. Service Level Agreement
13.1 Uptime Commitment
We strive to maintain 99.9% API uptime, excluding scheduled maintenance and force majeure events. Scheduled maintenance will be announced at least 24 hours in advance when possible.
13.2 Support
Support is provided via email. Response times vary by plan:
- Starter/Basic: 48-hour response time
- Pro: 24-hour response time
- Enterprise: Priority support with SLA
14. Modifications to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware, and you consent to personal jurisdiction in those courts.
16. Dispute Resolution
Before filing any claim, you agree to attempt to resolve disputes informally by contacting us. If we cannot resolve a dispute within 30 days, either party may pursue formal legal action as provided in Section 15.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and YugoVIN regarding the Service and supersede all prior agreements.
